By downloading, installing, or using Naily – Nail Design AI Tools (the "App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Naily ("we", "us", or "our"). You must be at least 13 years of age to use this App.

📱 2. Use of the App

Naily grants you a personal, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes. You agree to use the App only for lawful purposes and in accordance with these Terms.

• You must provide accurate information when using the App's features
• You are responsible for any images you upload
• The App is provided "as is" without warranties of any kind
• We reserve the right to modify or discontinue features at any time

🤖 3. AI-Generated Content

Naily uses artificial intelligence (powered by Google Vertex AI / Gemini) to generate nail care advice, design recommendations, and health assessments. By using these features, you acknowledge:

• Results may vary and are not guaranteed to be accurate
• Health assessments provided are general guidance, not medical diagnosis
• Colour suggestions are based on AI interpretation and may differ from real-world results
• We are not responsible for outcomes arising from following AI recommendations

©️ 4. Intellectual Property

All content within the App — including design, graphics, code, and text — is owned by Naily and protected by applicable intellectual property laws.

You retain ownership of any photos you upload. By uploading images, you grant us a limited, temporary licence to process them using our AI services solely to provide you with results.

🚫 5. Prohibited Conduct

You agree not to:

• Upload images that contain illegal, harmful, or offensive content
• Attempt to reverse-engineer, hack, or exploit the App
• Use the App for commercial scraping or data collection
• Violate any applicable local, national, or international laws
• Upload images of other individuals without their consent
• Attempt to circumvent Firebase App Check or other security measures

Violation of these terms may result in immediate termination of your access to the App.

⚖️ 6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING:

• Merchantability and fitness for a particular purpose
• Accuracy or completeness of AI-generated recommendations
• Uninterrupted or error-free operation of the App
• Results from following any advice provided within the App

🛡️ 7. Limitation of Liability

To the maximum extent permitted by applicable law, Naily and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
